Marsh Insights: Host Liquor Liability

Our way of thinking about consumption of alcohol is changing. Not only are tougher laws being enacted lowering the legal threshold for intoxication, but also the courts are now holding those who serve alcohol to a higher degree of accountability. Consequently, any business directly or indirectly engaged in the serving of alcohol, has a potential liquor liability exposure. For example, if a business function is held for the employees and alcohol is being served, the employer, as a host of the party or other social function:
- Could be held responsible for injuries or damages that occur as a result of the consumption of alcohol provided; or
- May be held responsible for the safety and behaviour of the guests until they are sober, not just until they leave the party or function.
