Event and Sponsorship Exposures – Direct and Contingent
It is not unusual for a high-profile corporate sponsor to be brought into a claim for injury or damages simply because their name is associated with the event. The practice of looking for potential “deep pocket” defendants is common in civil litigation. Insurance is available that is designed to protect the vicarious liability of companies that sponsor sporting and entertainment events and activities. This insurance is designed to protect the corporation’s core insurance program or self-insured retention.
Participant to Participant and Abuse Liability
Exposures arise from injury or property damage sustained by players, coaches, officials, or other participants in an activity. The risk of injury or damage to property can be significant considering the number of people who are in the middle of “the action”—or close to it. Members of Marsh’s Sports and Events Industry Practice specialize in both risk transfer and non-risk transfer solutions to address the unique risks of Participant and Professional Liability.
Risk Control – Visitor and Fan Safety, and Slip and Fall
Exposures arise from injury or property damage sustained by those who are observing the activity. The common ways a sports organization can be held liable are:
- Slip/trip/fall around playing field due to hazards such as holes, slippery surfaces, or uneven surfaces
- Slip/trip/fall off of bleachers
- Contact with ball caused by lack of barriers or defective barriers
- Contact with ball caused by improper positioning of players during warm-ups
Coverage for spectator liability is found in the general liability policy. Marsh assists clients with pre-event loss control activities and on-site claim services that, along with diligent contractual analysis, can be used to help control this exposure.
